AROMAB DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AVAILABILITY, SECURITY, OR THAT THE WEBSITE OR SERVICES WILL BE ERROR-FREE OR UNINTERRUPTED.

AROMAB DOES NOT WARRANT THAT THE WEBSITE, SERVICES, OR ANY CONTENT WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS.

ANY USE OF THE WEBSITE OR SERVICES IS AT YOUR SOLE RISK.

9. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AROMAB, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE WEBSITE OR SERVICES.

IN NO EVENT SHALL AROMAB'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE WEBSITE OR SERVICES EXCEED THE GREATER OF: (A) THE AMOUNT PAID BY YOU TO AROMAB DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR (B) ONE HUNDRED U.S. DOLLARS (US$100).

SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

10. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless AromAb, its affiliates, officers, directors, employees, contractors, licensors, and agents from and against any claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:

  • Your violation of these Terms;

  • Your violation of any applicable law or regulation; or

  • Your infringement of any third-party rights.

No waiver of any provision shall be deemed a further or continuing waiver of such provision or any other provision.
